The Supreme Court will soon hear arguments on the constitutionality of Proposition 8, the California ballot measure that defines marriage as being only between one man and one woman. I first read about the amicus curiae brief filed on behalf of the United States of America from a Mormon blogger, who was appalled by the brief's argument that the decision should not be based on morals. Are there no morals in the world, she asked? However, the brief I read expressed the view that morals cannot be the sole reason for making law.
Traditionally, proponents of gay and lesbian rights have ceded the turf of 'morality' to their opponents and have usually advocated the privatization of moral values. The essays in this fine collection engage social conservatives on their own terms in a variety of ways, and they demonstrate convincingly that recognition of same sex attraction and union can be defended vigorously on moral and ethical grounds. The contributors to this volume show that recognition of the legitimacy of same-sex unions is not simply a matter of morally neutral 'tolerance,' but that such unions can make positive contributions to the public interest.
Late last year, the Hawaiian circuit court ruled that the state had no compelling justification for denying gay and lesbian couples the right to wed. The decision opened up what may be the social debate of the decade, and these two titles help to bring the arguments into sharper focus. Debates over gay marriage involve both legal and social arguments, for and against. Legal arguments on behalf of gay marriage tend to get more attention because it should be a matter of basic civil and equal rights. Yet, it's not demonstrable that gay marriage is harmful.
The ruling is a major victory for same-sex couples, gay individuals, gay rights organisations and straight allies - those who are straight but support LGBT equality. But it should also come as a triumph for those whose conscience appeals to reason and the equal right to life and liberty of all human beings. In a global society where scientific advance, secular education and social mobility have redefined age-old theories of how we look at the world, the ruling is certainly the correct one.
